MICASAS Vacation Rentals Terms and Conditions

Welcome to MICASAS Vacation Rentals (“MICASAS,” “we,” “us,” or “our”), a platform connecting hosts offering vacation rentals with travelers seeking unique stays. By accessing or using our website, mobile apps, or services (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). These Terms govern your use of the Platform as a Host (offering properties) or Guest (booking properties). Please read them carefully. If you do not agree, you may not use the Platform.1.

Overview of MICASAS Services:

MICASAS provides an online marketplace where Hosts can list vacation rentals (e.g., homes, apartments, cabins) for free and Guests can discover and book stays. We charge Hosts a service fee only when a booking is confirmed, ensuring a low-risk way to reach global travelers. We are not a party to the agreement between Hosts and Guests but facilitate connections, payments, and support.2. Eligibility

  • You must be at least 18 years old and legally capable of entering contracts to use the Platform.
  • Hosts must own or have legal authority to offer their listed properties.
  • By registering, you confirm your compliance with all applicable local laws, including zoning, tax, and licensing requirements.

3. Account Registration

  • Free Registration: Hosts and Guests can create a MICASAS account at no cost. You agree to provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
  • MICASAS reserves the right to suspend or terminate accounts for misuse, fraud, or violation of these Terms.

4. Host Responsibilities

  • Listing Creation: Hosts can add and publish vacation rental listings for free, including property details, availability, and pricing. Listings must be accurate, up-to-date, and comply with local laws.
  • Images: Hosts must upload high-quality, truthful images of their properties, ensuring they have rights to use them.
  • Pricing and Fees: Hosts set their own prices. MICASAS charges a service fee (deducted from payouts) only when a booking is made, as outlined in our Pricing Policy.
  • Guest Interactions: Hosts must provide safe, clean, and accurately described properties, responding promptly to Guest inquiries and booking requests.
  • Compliance: Hosts are responsible for complying with local regulations, including taxes, permits, and safety standards.

5. Guest Responsibilities

  • Booking Process: Guests can browse and book vacation rentals via the Platform. Bookings are subject to Host approval and availability.
  • Conduct: Guests must respect properties, follow house rules, and comply with local laws during their stay.
  • Payments: Guests agree to pay the total booking amount, including rental fees, taxes, and any applicable MICASAS service fees, at the time of booking.

6. Payments and Fees

  • Host Fees: MICASAS charges Hosts a service fee (typically a percentage of the booking amount) only when a booking is confirmed. No upfront costs apply for listing or registration.
  • Guest Fees: Guests may incur service fees, taxes, or additional charges (e.g., cleaning fees) as displayed at checkout.
  • Payment Processing: Payments are processed securely via our third-party payment provider. Hosts receive payouts after Guest check-in, minus service fees, per our Payout Policy.
  • Cancellations and Refunds: Cancellations are governed by the Host’s chosen cancellation policy, displayed during booking. MICASAS may refund fees in certain cases, per our Refund Policy.

7. Cancellations, Modifications, and Disputes

  • Cancellations: Hosts and Guests must follow the cancellation policy selected for each booking. MICASAS facilitates communication but is not responsible for cancellation disputes.
  • Modifications: Booking changes are subject to Host approval and availability.
  • Disputes: Hosts and Guests should resolve issues directly. MICASAS may mediate disputes but is not liable for outcomes. Contact our support team for assistance.

8. Content and Intellectual Property

  • User Content: Hosts and Guests grant MICASAS a non-exclusive, worldwide, royalty-free license to use, display, and distribute content (e.g., listing photos, reviews) on the Platform for promotional purposes.
  • MICASAS Content: All Platform content (e.g., logos, designs) is owned by MICASAS or its licensors. You may not use it without permission.
  • Prohibited Content: Content must not be illegal, misleading, or infringe on third-party rights.

9. Prohibited ActivitiesYou agree not to:

  • Use the Platform for illegal purposes or in violation of local laws.
  • Misrepresent properties, pricing, or availability.
  • Harass, discriminate, or harm other users.
  • Attempt to bypass MICASAS’s payment system or fees.
  • Use automated tools (e.g., bots) to access or scrape the Platform.

10. Liability and Disclaimers

  • As-Is Service: MICASAS provides the Platform “as is” without warranties. We do not guarantee the accuracy of listings or the quality of stays.
  • Not a Party: MICASAS is not a party to Host-Guest agreements and is not liable for property conditions, Guest behavior, or disputes.
  • Limitation of Liability: To the fullest extent permitted by law, MICASAS is not liable for indirect, incidental, or consequential damages arising from Platform use.

11. Termination

  • MICASAS may suspend or terminate your account for violating these Terms, with or without notice.
  • You may deactivate your account at any time, but outstanding obligations (e.g., pending bookings) remain.

12. Governing Law and Dispute Resolution
